2. Service Description

Abod By Prem Misthan provides an online platform for ordering sweets, cakes, snacks, and other food items ("Products") for delivery or pickup. We reserve the right to modify or discontinue the Service at any time without prior notice.

3. Eligibility

The Service is intended for individuals aged 12 or older. If you are under 12, you may use the Service only with the involvement of a parent or legal guardian.

4. User Accounts

To place orders, you may be required to create an account. You are responsible for maintaining the confidentiality of your account details and for all activities conducted under your account.

5. Pricing & Taxes

All displayed prices include applicable taxes. Prices are subject to change without notice.

6. Ordering and Payments

Orders are subject to product availability. We accept various payment methods as displayed during checkout.

Operating Hours: Orders are accepted daily between 10:00 AM and 8:00 PM. Orders placed outside these hours may be scheduled for the next available delivery slot.

7. Delivery

Delivery times are estimates only. We are not responsible for delays caused by circumstances beyond our control. For location-based services, we collect your precise location only when necessary for delivery and with your explicit permission.

8. Cancellations and Refunds

Due to the perishable nature of our products, we follow a strict cancellation and refund policy. Please read carefully before placing your order:

  • Duplicate Orders: If you accidentally place the same order more than once, you are eligible for a full refund of the duplicate order amount. Please notify us immediately to process the refund.
  • Non-Delivery from Our Side: If we are unable to deliver your order due to reasons on our side (such as stock unavailability, technical issues, or delivery failure), we will issue a full refund to the original payment method within 2–3 business days.
  • Food Quality Issues: If the delivered product is found to be spoiled, damaged, or of unacceptable quality, you may request a refund or replacement within 2 hours of delivery. In such cases, we may require proof (such as photos of the product) to validate the claim.
  • Non-Refundable Situations:
    • Orders once prepared and dispatched cannot be cancelled.
    • No refunds will be provided for incorrect details given by the customer (such as wrong address or contact number).
    • Personal taste preferences do not qualify for a refund.

Refund Timeline: Approved refunds are processed within 2–3 business days and credited to the original payment method. Processing time may vary depending on your bank or payment provider.

9. Food Safety and Quality

We prepare all food items in compliance with applicable food safety regulations. However, customers with food allergies should exercise caution, as we cannot guarantee allergen-free preparation environments.

10. Intellectual Property

All content (logos, images, text) on our app/website is the property of Abod By Prem Misthan. Unauthorized use is strictly prohibited.

11. Limitation of Liability

We are not liable for delivery delays caused by external factors, third-party service failures (payment gateways, networks), or errors resulting from customer-provided incorrect information.

12. Modification of Terms

We may update these Terms at any time. Continued use of the Service after modifications indicates acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by Indian law. Any disputes shall be subject to the exclusive jurisdiction of the courts in Patna, Bihar.
